UPDATE TO RE-ENTRY VISA APPLICATION PROCESS

The Department of Justice has issued updated information regarding the process of applying for re-entry visas in emergency or extenuating circumstances.

Such circumstances include where an adult’s IRP card is lost or stolen, where it contains a significant error, or where they have not yet received their up-to-date IRP card by post prior to travel.

All applications must now be submitted via the Customer Service Portal.

Applications must be submitted in advance of planned travel, and applicants must provide proof of outbound and return flights, including details of connecting flights

If deemed applicable, applicants will be required to attend an in-person appointment at the Dublin Registration Office to obtain their re-entry visa.

Applications will be considered from details provided by each applicant, on a case-by-case basis. Therefore, applicants are encouraged to provide all relevant details and extenuating circumstances experienced.

Stamp 6 (without condition) holders who wish to obtain a re-entry visa must also follow this procedure.

Currently, children under the age of 16 are exempt from requiring re-entry visas, provided that they are accompanied by their parent or legal guardian who holds an in-date permission to reside in the State.

TRANSFER OF RESPONSIBILITY FOR FIRST TIME IMMIGRATION REGISTRATION

On 9th January 2025, the Department of Justice announced that the final remaining responsibility for first-time registration of Irish immigration residence permissions will transfer from the Garda National Immigration Bureau (GNIB) to the Immigration Service Delivery (ISD) of the Department of Justice.

This means that from 13th January 2025, there will no longer be any first-time registration appointments at a Garda registration office for people residing outside of Dublin. All first-time appointments, for applicants residing in all counties, will be now done at the Registration Office, 13-14 Burgh Quay, Dublin 2.

The notice confirms that individuals who have a confirmed appointment up to 31st January 2025, should attend the relevant Garda registration office as scheduled.

All nationwide online renewals of permissions are processed using the ISD Online Portal.

UPDATE TO ELIGIBILTY REQUIREMENTS FOR STAMP 4

The Department of Justice have recently changed the eligibility requirements for a Stamp 4 upgrade for employment permit holders. Please note that Stamp 4 support letters are no longer required for this upgrade, and your Stamp 4 permission can be registered at your registration office.

Effective from 3rd April 2024, employment permit holders with a Stamp 1 or 1H permission who have completed 21 months of employment are eligible for a Stamp 4 upgrade at their registration office.

The eligible categories include Critical Skills Employment Permit holder, individuals resident on the basis of a Hosting Agreement as a Researcher, or a Multi-Site General Employment Permit holder as a Non-Consultant Hospital Doctor.

General Employment Permit holders can now obtain a Stamp 4 after 57 months as opposed to 60 months. This means that General Employment Permit holders do not have to apply for long-term residence to the Immigration Service Delivery and can instead upgrade their permission to a Stamp 4 at their registration office.

A significant change to this is that the time period is now judged from date of commencement of employment, rather than the date of registration of Stamp 1 permission, as it had been previously. This had been a significant issue for employees recently due to long delays in registration. Commencement of employment in the State will be determined via your Employment Detail Summary, available on revenue.ie/myaccount.

ISD ANNOUNCE INITIATIVE TO FACILITATE NON-EEA NATIONALS WITH PENDING RENEWAL APPLICATIONS TO TRAVEL DURING CHRISTMAS

Immigration Service Delivery has recently announced an initiative to facilitate non-EEA nationals travelling during the Christmas period. The Registration Office is currently experiencing delays of 5-6 weeks in processing renewals of IRP cards. ISD has stated that after such renewals are completed, it may take a further two weeks to receive a new IRP card in the post.

 

Due to these delays, the Minister is issuing a Travel Confirmation Notice, requesting carriers to allow individuals to travel on their recently expired IRP where a renewal application for their IRP was submitted before the expiry of their current permission. This initiative has been introduced to facilitate nationals who are required to renew their current permission and who wish to travel internationally during Christmas.

 

Non-EEA nationals may use their current recently expired IRP card to enable them to travel from 9th December 2022 to 31st January 2023, provided an application for renewal was submitted in advance of the expiry date of their IRP card.

 

Those wishing to avail of the initiative must download and print the notice published by ISD, and present it along with their expired IRP card and proof of their renewal application to immigration authorities and airlines if requested to do so.
